What is a freelance late payment fee?

A freelance late payment fee is an extra charge when an invoice stays unpaid after its due date. It is about payment timing, not a cancel, a pause, or a faster delivery. Write net 14 days, a grace of 7 days, and one method: for example a flat €50, or 2% of the overdue balance per month, or the greater of those. Put it in the proposal before kickoff. What a late fee is (and is not)

A freelance late payment fee is a charge for an invoice that stays unpaid after its due date. Some contracts call the same charge a late charge. It is a payment-timing term. It is not a new piece of scope.

A late fee freelancers can point to later is one written before kickoff, with your own numbers. A number copied from someone else’s post is their choice. This page does not set a rate for you to copy.

  • A late fee is an unpaid invoice. The due date passed. The balance is still open. That is payment timing.

A written term tells the client what you will invoice if they pay late. It does not, by itself, collect the money or decide a dispute. Some places have their own late-payment rules. This page does not name a country, a required rate, or a result a court must reach.

When it applies

Write the window before kickoff. Then use it only for an invoice that is actually overdue.

  • You issued an invoice. It names an amount and a due date: net 14 days from the invoice date.
  • The due date passed. The balance is still unpaid.
  • Grace, if you wrote one. The late fee starts only after a further 7 days. Put that number in the proposal. This page does not set how long grace should last.
  • A cancel is a different term. Ending the project after kickoff is a kill fee, not a late fee.

One-time flat fee

€50 once, after the due date plus a grace of 7 days.

% of the overdue balance

2% of the unpaid invoice, once, or each month after grace. You choose whether it repeats.

Greater of the two

The greater of a flat €50 or 2% of the overdue balance.

One method per project. Say whether the fee is one-time or repeats each month. This page does not tell you to call that fee interest, and it does not name a legal interest rate.

Wording in the proposal / SOW

A late payment clause in a freelance contract is these fields, written before kickoff.

  • Net days. Payment is due net 14 days from the invoice date.
  • Grace. The late fee starts 14 days after the due date, and only on the unpaid balance.
  • Fee. The method you chose, and the amount (for example €50 or 2%). Say if it is one-time or repeats each month.
  • New work. New work waits until the overdue invoice is paid until the overdue invoice is paid. That wait is not a pause fee. A pause fee is for when the client goes quiet.
  • Deposit. Money already held up front stays separate. It is not the late fee.

Soft email path

Keep the notes short, in this order: a reminder before the due date, a note during the grace window, then a short overdue note. The overdue note names the invoice, the original due date, and the late fee already written in the proposal. This page does not include those scripts.
